Terms of Service

These Terms govern access to sexxWise. They are a contractual agreement separate from the Privacy Policy, which explains information handling, and separate from optional consents for sensitive processing, Explore, adult text, cookies, marketing, or Together sharing.

sexxWise is operated by Sexxwise Inc., trading as sexxWise. Registered address: 100 Main Street, Suite 100, Wilmington, DE 19801, USA. These company details require completion before production.

A user must have legal capacity to enter these Terms and must meet the minimum age and any jurisdiction-specific eligibility rules. sexxWise may restrict access where the service or a feature is not lawfully available.

sexxWise is intended only for adults who are at least 18 and meet any higher minimum age in their jurisdiction. Self-attestation may not be sufficient everywhere. sexxWise may require additional age assurance for specific locations or features.

Users must provide accurate account-access information, can use an alias instead of a legal name, and must not create an account for an ineligible person. Terms acceptance is recorded separately from privacy notice acknowledgment and optional consents.

Users are responsible for reasonable protection of credentials and for promptly reporting suspected unauthorized access. sexxWise may revoke sessions or require reauthentication to protect an account.

Where anonymous access is available, access can be lost if the device or session is lost before the account is linked to a durable sign-in method. Linking should preserve the same user identity and data rather than create a new account.

sexxWise provides private tracking, health organization, education, reflection, communication, optional adult text, personalization, reporting, and subscription functions. Features can change as the service develops, subject to notice and consumer rights.

Health features provide general information, tracking, reminders, and organization. They are not diagnosis, treatment, prescriptions, clinical testing, emergency services, or a doctor-patient relationship. The Health & Wellness Disclaimer forms part of these Terms.

Users decide what to record and are responsible for the accuracy of their entries. sexxWise does not certify safety, STI status, fertility, pregnancy, contraception effectiveness, consent, relationship quality, or sexual performance.

Together shares only information intentionally placed in the shared space or disclosed through a clear sharing action. Users must respect the other person's privacy and have the right to share any submitted material. Linking does not expose private personal records.

Explore is optional, restricted to eligible adults, and requires separate activation. sexxWise may restrict Explore by jurisdiction or provider requirements. Health and Activity information is not used to infer adult-content preferences under the current product policy.

sexxWise and licensed stories are provided for personal service use only. Third-party or licensed content remains owned by its rights holder and may not be redistributed, scraped, copied, or commercially exploited outside authorized use.

Fantasy Chat is fictional adult entertainment. Characters must be fictional adults. The service may apply automated safety controls and may refuse or end prohibited scenarios. Chat output does not represent a real person's thoughts or feelings.

AI output can be inaccurate, repetitive, unexpected, or inconsistent. Users should review generated content and must not rely on it as medical, legal, mental-health, or relationship advice. Generation features are subject to the AI & Generated Content Policy.

Users retain ownership of content they lawfully submit where applicable. They grant sexxWise only the limited rights reasonably needed to store, process, display back, share when explicitly requested, generate requested features, secure the service, and operate it as legally permitted. sexxWise does not claim a perpetual public commercial license over private notes, health records, chats, or Together conversations.

Users must follow the Acceptable Use and Adult Content policies. Prohibited conduct includes illegal use, underage access, exploitation, harassment, threats, doxxing, non-consensual intimate content, abuse of APIs, scraping, security attacks, age-control circumvention, fraud, payment abuse, and intellectual-property infringement.

sexxWise uses providers such as Firebase/Google Cloud, Polar, and DeepSeek. External services and sites have their own terms and policies. sexxWise does not control external sites merely because it links to them.

sexxWise software, trademarks, design, editorial material, illustrations, and proprietary content are protected by applicable law. Except for permitted personal use of the service, users may not copy, modify, distribute, reverse engineer, scrape, or commercially exploit sexxWise assets.

sexxWise offers Free, Plus, and Premium plans. Paid features, limits, current price, currency, billing interval, and renewal terms must be shown before checkout. The Subscriptions & Billing Policy forms part of these Terms.

If a trial is offered, checkout must state the eligibility rules, duration, post-trial price, currency, billing interval, renewal date, and cancellation process. Trial architecture or marketing copy alone does not establish a live trial.

Monthly and annual subscriptions renew automatically until canceled when shown at checkout. The user should review the exact plan, price, currency, billing interval, taxes, trial terms, and renewal amount before authorizing payment.

Cancellation is available through Settings, Subscription, and the Polar customer portal. Unless required otherwise, cancellation stops the next renewal and paid access continues through the current billing period. The user should receive clear confirmation of the effective end date.

Refund rules are NEEDS BILLING PROVIDER + LEGAL REVIEW. Mandatory statutory, consumer, billing-provider, and app-store rights remain available where applicable. sexxWise must not publish a universal no-refund rule before review.

Prices may exclude or include taxes depending on location and provider configuration. Taxes and the final amount should be displayed before payment where required.

sexxWise may add, modify, limit, or discontinue features. Material changes affecting paid value, privacy, adult-content access, or legal rights require appropriate notice and must preserve mandatory consumer protections.

sexxWise may restrict or suspend access to protect users, enforce age eligibility, investigate serious security or policy violations, address payment issues, or comply with law. Actions should be proportionate and provide an appeal or contact path where appropriate.

sexxWise may terminate an account for serious or repeated Terms violations, unlawful conduct, exploitation, security attacks, or ineligibility. Termination does not eliminate billing, legal, dispute, or record-retention obligations that lawfully survive.

Users can request account deletion. Active subscriptions must be addressed explicitly. Deletion removes user data according to the documented workflow and retention schedule; it may not instantly erase immutable or rotating backups.

sexxWise is provided subject to an approved warranty structure and applicable consumer law. The service may be unavailable, contain errors, or produce incomplete insights. sexxWise does not guarantee medical outcomes, relationship outcomes, uninterrupted service, or that generated content will always be accurate or suitable.

The limitation of liability, exclusions, and any liability cap require counsel approval. Nothing in these Terms excludes liability that cannot legally be excluded or limits mandatory consumer rights.

No broad indemnification obligation is finalized in this draft. Any indemnification provision must be proportionate, permitted by applicable law, and approved by counsel.

Nothing in these Terms is intended to remove rights, remedies, guarantees, or protections that cannot lawfully be waived under applicable consumer law.

The dispute process is not finalized. sexxWise has not automatically enabled mandatory arbitration, a class-action waiver, or a particular informal-resolution period. Jurisdiction-specific alternatives require counsel review.

State of Delaware, USA. Courts: State and Federal Courts located in Wilmington, Delaware, USA. Mandatory local consumer protections may still apply.

sexxWise versions the Terms. Material changes may require advance notice or renewed acceptance. Old acceptance records remain auditable. Declining a mandatory update must follow an approved access and data-rights process.

The final Terms require counsel-reviewed provisions addressing severability, assignment, waiver, survival, language, entire agreement, notices, and conflicts between policies. No generated boilerplate is treated as approved.
